Intellectual Property (Industrial Property and Copyright) is a fundamental mechanism for protecting the results of creative and inventive activities. It is associated with the scientific, technological, economic and social development within a modern and global competitive market. Creators and innovators have a system with effective tools that guarantee and protect exclusive rights of use and marketing, enabling a return on work and investment, as well as fostering innovation and growth.
In Portugal, the Industrial Property Code establishes the protection of patents, utility models, industrial designs and models, and the INPI – National Institute of Industrial Property, an agency of the Ministry of Justice, is responsible for the attribution and protection of industrial property rights, as well as the promotion of national trademarks, patentes, and designs outsider Portugal.
According to INPI, more than 21,000 applications for trademarks, logos and other distinctive trade signs were registered in 2017, a 7% increase over the previous year. Inventions (patents and utility models) have fallen. At the EU level, EUIPO – the European Union Intellectual Property Institute, the agency that manages EU trademark and design rights, examines, on average, 115,000 trademark applications and 85,000 applications for designs a year.
